Official Contest Rules
No Purchase Necessary
NO PURCHASE NECESSARY to enter or win. Void where prohibited. The "Talk to Chuck" Contest ("Contest") begins 12:01am ET 11/14/07 and ends 11:59pm ET 02/29/08 ("Promotion Period"). Contest is sponsored by Charles Schwab & Co., Inc. ("Schwab" or the "Sponsor") 101 Montgomery Street, San Francisco, CA 94104. The Contest is governed by these Official Rules, and is subject to all applicable U.S. federal, state and local laws, and is void wherever prohibited by law. In order to enter the Contest or receive the prize, you must fully comply with the Official Rules, and by entering you agree to be bound by these Official Rules and the decisions of Sponsors, whose decisions shall be binding and final in all respects.
1. Eligibility
Any legal U.S. resident age twenty-one or over can enter, except:
- Employees, agents, or representatives of Sponsor, Condé Nast Publications, FINRA or any of its parents, subsidiaries, or affiliates, their respective agencies that have contest related responsibility, or any member of their immediate families.
- "Immediate family" shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses, regardless of where they live.
2. How to Enter
To enter, visit www.talktochuck.com (the "Web Site") during the Promotion Period and completely fill out all the required fields on the registration form. Then create an original "bubble" ("Submission") which describes a financial/investment related issue. Then enter your registration form and Submission by following the onscreen instructions. ALL SUBMISSIONS MUST BE RECEIVED BY 11:59 pm ET, February 29, 2008. Limit one (1) Submission per person throughout the Promotion Period. Submissions by the same person in excess of the limits stated herein will be disqualified. Submissions will be deemed to have been submitted by the authorized account holder of the e-mail address at the time Submission was entered. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
3. Submission Requirements
Submissions (1) cannot be derogatory of any ethnic, racial, gender, religious, professional or age group; (2) must be original in all respects and must not infringe upon the rights of any third parties; (3) must be timely received to be considered.
4. Judging
All Submissions will be reviewed by a panel of judges on the following criteria: (1) originality - (50%); (2) creativity - (50%).
5. Winner Notification
Potential winners will be notified by e-mail or phone, using the information provided on his/her Entry, on or about March 15, 2008. In the event: (a) potential winner cannot be reached for whatever reason after a reasonable effort has been exerted based on the information stated in the Entry, (b) of noncompliance with the above, (c) a potential winner is found to be ineligible to enter the contest, (d) a potential winner cannot or does not comply with the Official Rules, the potential winner shall be disqualified from the Contest and an alternate potential winner may be selected, at Sponsor's sole discretion, from among the other eligible entries received. Winner selection is under the supervision of Sponsor, whose decisions are final and binding in all respects.
6. Prizes
Eleven (11) prize(s) will be awarded to eleven (11) qualified winners.
- (1) One Grand Prize of $10,000
- (10) Ten runner-up prizes of $1,000 each
If a winner is an existing Schwab client the prize will be deposited to his/her Schwab OneŽ Brokerage Account. If a winner does not have a Schwab One Brokerage Account a Schwab representative will assist him/her in opening such account in order to receive his/her prize. All prize monies will be deposited into a Schwab OneŽ Brokerage Account on or around March 30, 2008. The Prizes are not transferable. There are no substitutions for the Prizes.
7. Copyright
All entries become the property of Schwab and will not be acknowledged or returned. By entering the Contest, you assign all rights, title and interest in your Submission and agree to sign any documents that may be necessary to effect such transfer.
8. Release of Liability; Disclaimer of Warranty
By participating in the Contest, entrants and winner agree to release and hold harmless Sponsor and its parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors, from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage or personal injury (including emotional distress), which may occur in connection with preparation for, or participation in, the Contest, participation in any Contest-related activity and for any claims or causes of action based on publicity rights, defamation or invasion of privacy. Sponsor and its parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors assume no responsibility for any injury or damage to entrants or to any other person's computer, regardless of how caused, relating to or resulting from entering this Contest.
Potential Winners will be required to execute and return an Affidavit of Eligibility, Liability and Publicity Release, as well as any other documents which may be required or requested by Sponsor, all of which must be received fully executed within seven (7) days of date printed on notification, or he/she may be disqualified.
9. Substitution; Taxes
No assignment or transfer of prizes will be permitted, except at Sponsor's sole discretion. Sponsor reserves the right to substitute a prize with one of comparable or greater value if advertised prize is unavailable. WINNER IS SOLELY RESPONSIBLE FOR ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE.
10. Potential Winner
(a) Release. By participating in this Contest or receiving a prize, entrants agree to release and to indemnify and hold harmless Sponsor and Condé Nast Publications from any liability, injury, death, loss or damages to entrant or any person or entity, including without limitation damage to personal or real property, caused in whole or in part, directly or indirectly, by participation in this Contest (or related activities) or the acceptance, possession or use/misuse of a prize.
(b) Publicity. Except where prohibited, participation in this Contest constitutes entrant's consent to Sponsor and its agents' to use entrant's name, business or company name, likeness, voice, opinions and biographical information for publicity, advertising, trade or promotional purposes in any media or manner, without further payment, consideration, notice or approval, unless prohibited by law.
11. Conditions of Participation
Sponsor reserves the right in its sole discretion, to modify, cancel, terminate, and/or suspend the Contest and to disqualify any individual who tampers with the entry process, violates these official rules, or acts in a disruptive or unsportsmanlike manner. Without limiting the foregoing, Sponsor may lock out an entrant who, in Sponsor's sole judgment, has been disqualified, has questionable eligibility or is otherwise ineligible to enter. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Contest or in the announcement of the prize. If, for any reason, the Contest is not capable of running as planned for any reason which corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest. Sponsor reserves the right, but not the obligation, to select winners from eligible entries received as of the termination date and time.
12. Disputes/Choice Of Law.
Except where prohibited, each entrant agrees that this Contest shall be governed by the laws of the State of California and: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by state or federal courts situated in San Francisco, California (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys' fees; and (3) no punitive, incidental, special, consequential or other damages, including without limitation lost profits may be awarded (collectively, "Special Damages"), and (4) entrant hereby waives all rights to claim Special Damages and all rights to have such damages multiplied or increased.
13. Privacy
Personally identifiable information that is submitted by entrants as part of this Contest will be used to administer the Contest, select prize winner and fulfill prizes, and will be treated in accordance with Sponsor's privacy policy accessible on its website at www.schwab.com.
